Desktop License – End User License Agreement (EULA)

Version 1.0

This agreement is between ‘You’ the User or Licensee and Type Atelier. For the purposes of the license, “Font Software” shall be defined as coded and encrypted software that when used with the appropriate hardware and software generates typeface and typographic designs and symbols. Type Atelier grants you a non-exclusive terminable license to use the Software, provided that you agree to the following:

By purchasing and/or installing Type Atelier Font Software you agree to the following terms:

  1. The Desktop License for a Type Atelier font grants you permission to install and use it at one (1) location with a maximum of two (2) users. Users should work for the same organisation and at the same location. Use of the Type Atelier Font Software at more than one (1) location or with more than two (2) users requires a License upgrade.
  2. Upon the purchase of the license and payment in full, you become a licensed user not an owner of the software. Purchased fonts will remain the copyright of Type Atelier and their creators.
  3. A Desktop License allows the user to utilise the Font Software in any material produced on a desktop machine such as, but not limited to, a logo, business card or publication.
  4. You are permitted to use the Type Atelier Font Software to create logos provided the font is converted to outlines. You are permitted to use the Type Atelier Font Software for flattened images on websites provided the Font software is not embedded onto a server. This license does not allow the font to be loaded onto a server that provides for multiple users.
  5. You are permitted to take a digitised copy of the Type Atelier Font Software used for a particular document, or Font Software embedded in an electronic document, to a commercial printer or service bureau for use by the printer or service bureau in printing such document provided that the printer service bureau confirms that it shall destroy any and all copies of the Type Atelier Font Software upon completion of its work.
  6. You may make one (1) backup copy of the Type Atelier Font Software for archival purposes only, and you agree to retain exclusive custody and control over any such copy.
  7. You are not permitted to convert the .OTF file to any other file formats. Should you wish to self-host our typefaces online please purchase the appropriate license.
  8. You are not permitted to modify, alter, edit, adapt, disassemble, reverse engineer, decompile, disassemble or otherwise copy the Type Atelier Font Software.
  9. The Type Atelier Font Software may not be sold, licensed, sublicensed, lent, shared, leased, distributed or given away to another person or entity. You agree not to base your own font on Type Atelier Font Software character designs.
  10. Type Atelier reserves the right to request proof of the license at anytime.
  11. Type Atelier warrants that the Font Software will function correctly for a seven (7) day time period after purchase. Due to the nature of Font Software we do not give refunds on license purchases. If the Font Software does not function correctly, you must contact us within seven (7) days of purchase to arrange a replacement. All purchases are final.
  12. Type Atelier shall in no event be liable to you or any other third party for any direct, indirect, consequential, or incidental damages, including lost profits, lost savings, business interruption, loss of business information, as a result of the use or inability to use the product even if notified in advance of such possibility. You hereby agree that your entire, exclusive, and cumulative liability and remedy shall be limited to the cost of the Font Software. Under no circumstances shall Type Atelier’s liability to you exceed the replacement cost of the software, which shall be at the sole discretion of Type Atelier.
  13. All Type Atelier Font Software is installed at the user’s risk and Type Atelier will not be held responsible. Under no circumstances does Type Atelier take responsibility for damage caused to a user’s hardware, software or a loss of income as a result.
  14. The Type Atelier Font Software is protected under copyright law.
  15. Font licenses are non-transferrable and are licensed to the original buyer only unless you possess an agreement in writing by Type Atelier.
  16. Breach of any of these terms will result in the immediate termination of the contract. Type Atelier will revoke the license for the purchased fonts without refund. Upon termination of the agreement, you agree to destroy any and all copies of the Font Software and certify that no copies remain in your possession or control.
  17. Type Atelier has no control over currency conversion rates or bank fees you may incur when purchasing from us.
  18. The laws of the Commonwealth of Australia shall govern this agreement. The court of jurisdiction is in Brisbane, Australia.
  19. Should a regulation of this contract be invalid in whole or part, the validity of other regulations shall remain unaffected.

 

WebFont license – End User License Agreement (EULA)

Type Atelier grants you a non-exclusive terminable license to use the Software, provided that you agree to the following:

By purchasing and/or installing Type Atelier Font Software you agree to the following terms:

  1. The WebFont License for a Type Atelier font grants you permission to use that font on one (1) web domain owned and exclusively managed by a single person or company/organisation. Should your usage exceed that limit multiple licenses must be purchased. Each license is non transferrable.
  2. Upon the purchase of the license and payment in full, you become a licensed user not an owner of the software. Purchased fonts will remain the copyright of Type Atelier and their creators.
  3. Type Atelier WebFonts are licensed and priced according to monthly visitors. You must monitor your domain’s visitors with regards to this License. If your visitors exceed the one stated on your receipt/invoice, you are required to purchase the appropriate license upgrade. The license does not expire.
  4. You may make one (1) backup copy of the Type Atelier Font Software for archival purposes only, and you agree to retain exclusive custody and control over any such copy.
  5. The Type Atelier Font Software is not permitted to be shared across multiple websites or domains via any form of network or server.
  6. This license is only for rendering of live selectable text on a website platform. You are not permitted to utilise the supplied WebFonts to create bitmap or vector images. Should you wish to create static images for online use, a Desktop License must be purchased.
  7. You are not permitted to convert the provided files (.WOFF, .WOFF2 and .EOT) to any other file formats such as .OTF or .TTF. Should you wish to use the Type Atelier Font Software in a desktop program such as Illustrator, Photoshop or InDesign please purchase a Desktop License.

App / Epub License – End User License Agreement

Version 1.0

This agreement is between ‘You’ the User or Licensee and Type Atelier. For the purposes of the license, “Font Software” shall be defined as coded and encrypted software that when used with the appropriate hardware and software generates typeface and typographic designs and symbols. Type Atelier grants you a non-exclusive terminable license to use the Software, provided that you agree to the following:

By purchasing and/or installing Type Atelier Font Software you agree to the following terms:

  1. An App / Epub License for a Type Atelier font grants you permission to install or imbed that font on either one (1) Application on a mobile or desktop platform, or one (1) Epub (Electronic Publication). Should you require the Type Atelier Font Software in multiple applications or on multiple software platforms please purchase the appropriate license. Each version is regarded as a separate App under this license. Users should work for the same organisation and at the same location. Should you require the use of the Type Atelier Font Software in multiple locations please contact us.
  2. In addition, your purchase of an App / Epub License also permits the use of the Type Atelier Font Software governed by the Desktop License.
  3. You agree not to use the Type Atelier Font Software in an application that outputs files in formats such as JPG, PNG, PDF (or any other static image type), vector images or text documents. The use of the Type Atelier Font Software is strictly limited to within your application for text display only purposes.
  4. Upon the purchase of the license and payment in full, you become a licensed user not an owner of the software. Purchased fonts will remain the copyright of Type Atelier and their creators.
  5. Broadcasting License – End User License Agreement

Should you wish to use the Type Atelier Font Software in broadcasting on television, feature films, documentaries, cartoons / animations, or console video games you will need to purchase a Broadcasting License. Please contact us for further details.
